Teema 6. Review and comments of Pirate Party proposals to Copyright laws.

The source of the document is located here: The Case For Copyright Reform (2012) Engstrom-Falkvinge.pdf

The main proposals are outlined in the Chapter 2 of above document.

I start with outlining my general approach to Pirate Party proposals: with most of them I do agree with in spirit (if not always to the letter).
The progress of humanity was hampered on many (well documented) occasions by corporations. Corporations used existing Copyright laws to prevent innovations from being used by the public, due to the potential risk of damaging their revenues. Laws are created in the interest of the people

However, not all approaches suggested by Pirate Party I can fully agree with, but we can review them one by one below.

  • Moral rights unchanged
    • “Credit is where credit due” - no arguments, authors suggest to leave as is and i fully agree.
  • Free non-commercial sharing
    • Positives are undeniable in using p2p technology for sharing large files free allow to legal, free or non-profits distribution (linux distributives or large-resolution images for astronomy) - and these should remain free and unhindered.
    • But critical point is that the origin of these files have to be legal. Pirated software, movies or music - where authors or copyright holders are not happy about free distribution - have to be banned from sharing via P2P. this is there technology has to serve not only to the “right of use”, but also to the responsibility of fair usage.
  • 20 Years Of Commercial Monopoly
    • Change from 70 years to 20 years - makes total sense. Sleeping on the cushion of wealth created by your forebears almost has no positive examples how this did end well for siblings for the author. At the same time it cannot be shorter as spouses, who are often uncredited co-authors have to have the benefit
  • Registration After 5 Years
    • Makes practical sense. I agree.
  • Free Sampling
    • Mixing, combining and creating parodies is well known as fun and creative activity. This is clearly in public interests, so let it be legal :)
  • A Ban on DRM
    • Here I have the same viewpoint as towards P2P: technology is good, the usage of it, however, has to be regulated and adjusted.
    • DRM technology has to stay, as it has benefits, but its usage have to be regulated by laws, not by corporations.

As a conclusion, Pirate Party, as being true politicians, have some pretty good common sense approaches in their manifesto, and at the same time they also have some populistic agendas. politicians , eh.
